Legal Protection of Workers in Labor Criminal Offenses: A Case Study on Outsourcing Companies

The outsourcing system has rapidly emerged as a significant phenomenon in Indonesia, generating complex issues in the realm of labor law, particularly in relation to the legal protection of workers. While the flexibility offered by outsourcing provides efficiency benefits to companies, it frequently leads to practices that undermine workers’ rights, such as discriminatory treatment, job insecurity, and diminished access to social security and welfare. Legal uncertainty regarding the status of outsourced workers creates opportunities for exploitation, whereby employers often utilize short-term employment contracts to evade legal responsibilities mandated by labor regulations. This study analyzes the legal protection of outsourced workers in Indonesia through a normative juridical approach, examining relevant statutes, literature, and case studies pertaining to workers’ rights. The findings reveal that regulatory loopholes and ineffectiveness, weak supervisory mechanisms, and limited legal literacy among workers are primary factors contributing to the widespread violation of outsourced workers’ rights. These problems are further exacerbated by emergency situations such as the COVID-19 pandemic, which have led to unilateral terminations and wage suspension without adequate protection. Efforts by the state to enforce labor law continue to encounter numerous obstacles, including the insufficient number and limited capacity of labor inspectors. A comparative analysis of outsourcing protection in other jurisdictions indicates the need for regulatory reform and strengthened supervisory measures as viable solutions. Accordingly, this study recommends the amendment of labor regulations, the optimization of governmental oversight, and the empowerment of workers through enhanced legal literacy as both preventive and repressive strategies to improve the legal protection of outsourced workers in Indonesia.
