The Implementation of Regulatory Frameworks and Legal Protection Challenges for Consumers in Traditional Medicine Practices in Indonesia

Abstract

Traditional medicine represents a dynamic form of healthcare service that has grown and evolved within Indonesian society. This practice is rooted in local traditions as a cultural heritage and has become an effective alternative in healthcare delivery, particularly among communities with limited access to modern medical services. However, the proliferation of traditional medical practices without standardized protocols raises significant concerns regarding legal protection and consumer safety. This study aims to conduct an in-depth analysis of the legal regulation of traditional medicine in Indonesia and evaluate the effectiveness of its implementation in providing legal protection for consumers. Employing a normative juridical research method, this study identifies and examines various relevant regulations, such as Law No. 17 of 2023 on Health, Law No. 8 of 1999 on Consumer Protection, Government Regulation No. 103 of 2014, and technical provisions set forth by the Ministry of Health. The research findings demonstrate that Indonesian regulation of traditional medicine is substantively adequate in terms of guidance, supervision, and mechanisms for business actors’ accountability. Nevertheless, implementation in practice still faces challenges, including low legal awareness, limited supervisory capacity, and insufficient public understanding of their rights and available legal protection mechanisms. Therefore, synergy among the government, business actors, and the community is necessary to enhance the effectiveness of regulatory implementation, reinforce the legal protection system, and promote the development of safe, accountable, and equitable traditional medicine services. This study recommends strengthening supervisory systems, intensifying regulatory dissemination, and optimizing technology utilization within traditional medicine services.
